SPÓŁKI 3DGENCE SP Z O.O. Z SIEDZIBĄ W KATOWICACH
§ 1. Definicje
Użyte w regulaminie sformułowania, oznaczają:
a. Sprzedawca – 3DGence sp. z o.o., z siedzibą w Katowicach, ulica Mickiewicza 29, 40-085 Katowice, wpisana do Rejestru Przedsiębiorców Krajowego Rejestru Sądowego prowadzonego przez Sąd Rejonowy Katowice-Wschód w Katowicach, Wydział VIII Gospodarczy Krajowego Rejestru Sądowego pod nr KRS 0000265431, NIP 6330009438, REGON 271077426, zajmująca się sprzedażą drukarek 3D oraz świadcząca usługi wydruku 3D,
b. Klient – osoba fizyczna, przedsiębiorca, który składa zamówienie na wycenę wydruku 3D,
c. Witryna internetowa – strona internetowa Sprzedawcy, która umożliwia dokonanie szacunkowej wyceny wydruku 3D,
d. Wyceniarka- narzędzie umieszczone na stronie internetowej Sprzedawcy służące do wyceny plików inżynieryjnych,
e. Umowa sprzedaży – zawarta pomiędzy Klientem, a Sprzedawcą umowa której przedmiotem zakupu może być wydruk 3D, lub drukarka 3D.
f. Zamówienie – złożone za pośrednictwem Wyceniarki zlecenie na dokonanie wyceny wydruku plików inżynieryjnych w formacie 3D.
g. Pliki inżynieryjne- pliki przekazywane przez Klienta do wyceny i stanowiące jego własność.
h. Administrator- podmiot, który ustala cele i zasady przetwarzania danych osobowych.
§ 2. Postanowienia ogólne
1. Niniejszy regulaminu określa zasady składania zamówień na wycenę Plików inżynieryjnych.
2. Warunkiem dokonania wyceny Plików inżynieryjnych jest akceptacja niniejszego regulaminu.
3. Akceptacja niniejszego regulaminu oznacza, że Klient zgadza się i akceptuje wszystkie warunki wyceny Plików inżynieryjnych, w tym wyraża zgodę na przetwarzanie jego danych osobowych.
§ 3. Zamówienie
1. W celu złożenia Zamówienia i otrzymania wyceny wydruku 3D Plików inżynieryjnych, Klient jest zobowiązany podać adres email, na który zostanie przesłana wycena.
2. Składając zamówienie Klient zgadza się na dokonanie modyfikacji Plików inżynieryjnych niezbędnych do wykonania wydruku 3D. Sprzedawca nie ponosi odpowiedzialności za modyfikację Plików Inżynieryjnych niezbędnych do wykonania wyceny.
3. Realizacja Zamówienia na wycenę wydruku Plików inżynieryjnych jest bezpłatna.
4. Wycena, o której mowa w ustępie powyżej, nastąpi po upływie kilku sekund. Wycena ma charakter wyłącznie poglądowy. Ostateczna cena wydruku Plików inżynieryjnych, może odbiegać od tej, wskazanej w ramach działania Wyceniarki.
5. Pliki inżynieryjne przekazane za pośrednictwem Wyceniarki, zostaną wykorzystane wyłącznie w celu dokonania wyceny w ramach dozwolonego użytku o czym mowa w art. 23¹ Ustawy z dnia 4 lutego 1994 roku o prawie autorskim i prawach pokrewnych, czyli przede wszystkim w zakresie wyceny Wydruku plików inżynieryjnych.
§ 4. Sprzedaż
Po otrzymaniu wyceny, w celu zawarcia Umowy sprzedaży Klient musi skontaktować się telefonicznie – //// lub mailowo – ///// z pracownikiem Sprzedawcy.
§ 5. Wady wyceniarki, Odpowiedzialność
1. W przypadku nieprawidłowego działania Wyceniarki Klient może zgłosić swoje uwagi i zastrzeżenia wysyłając maila na adres://// .
2. W związku z tym, że Sprzedawca udostępnia Klientowi bezpłatnie narzędzie do dokonania wyceny, Klient zgadza się i akceptuje, iż Sprzedawca zostaje zwolniony z ewentualnej odpowiedzialności za szkody powstałe na skutek utraty, uszkodzenia, ujawnienia lub zmiany Plików inżynieryjnych Klienta.
§ 6. Dane osobowe
1. W celu dokonania wyceny plików inżynieryjnych Klient przekazuje swoje dane osobowe w postaci adres email.

4. Sprzedawca przetwarza przekazane przez Klienta dane osobowe tylko w celu dokonania wyceny plików inżynieryjnych.
5. Postawą przetwarzania danych osobowych Klienta jest zgoda Klienta.
6. Sprzedawca będzie przetwarzał przekazane przez Klienta dane osobowe przez okres 2 lat.
7. Odbiorcami danych osobowych Klienta będą podmioty świadczące usługi z zakresu IT, w tym podmiot od którego Sprzedawca zakupił narzędzie do wyceny, tj. Autonomous Manufacturing Ltd of 1 East Poultry Avenue, London, EC1A 9PT, Company Number 8486322.
8. Sprzedawca nie będzie przekazywał danych osobowych poza teren EOG.
9. W związku z przetwarzaniem danych osobowych, osobie której dane dotyczą przysługuje prawo do:
a) Dostępu do danych osobowych
b) Poprawiania i zmiany danych osobowych
c) Żądania zaprzestania przetwarzania danych osobowych
d) Wniesienia sprzeciwu wobec przetwarzania danych osobowych
e) Żądania usunięcia danych osobowych
f) Ograniczenia przetwarzania danych osobowych
g) Przeniesienia danych osobowych.

§ 8. Postanowienia końcowe
1. Sprzedawca jest uprawniony jest do jednostronnej zmiany niniejszego regulaminu.
2. W przypadku nieważności lub niemożności zastosowania któregoś z postanowień regulaminowych, reszta regulacji pozostaje w mocy prawnej.
3. Wszelkie spory pomiędzy Sprzedawcą, a Klientem rozpatrywać będą sądy właściwe ze względu na siedzibę Sprzedawcy, właściwe zaś jest prawo polskie.
